Court Nullifies Gor Mahia Patron Appointment, Citing Constitutional Breach

Nairobi, Kenya – Gor Mahia Football Club faces a significant governance challenge following a ruling by the Sports Disputes Tribunal (SDT) that nullified the appointment of Eliud Owalo as the club's patron. The tribunal declared Owalo's confirmation unconstitutional, asserting that the power to appoint a patron rests exclusively with the club's Board of Trustees, an organ that has not been constituted since the club adopted its constitution in 2019.

The SDT's decision, issued on August 5, 2026, found that the Executive Committee, which appointed Owalo, acted beyond its constitutional mandate. The case was initiated by Sam Ochola, a life member and former secretary-general of Gor Mahia, who contended that Owalo's appointment violated the club's foundational documents. The tribunal further clarified that the roles of "Acting Patron" and "Deputy Patron" are not recognized within the club's constitutional framework.

As a direct consequence of the ruling, Gor Mahia has been ordered to convene an Annual General Meeting (AGM) within 60 days. This meeting is tasked with identifying and nominating members for a Board of Trustees, which will then be responsible for appointing a patron in strict accordance with the club's constitution. The ruling explicitly stated: "The confirmation of Hon. Eliud Owalo as Patron of Gor Mahia Football Club was ultra vires and undertaken by an organ lacking the constitutional mandate to do so. The said confirmation is hereby declared null and void ab initio and of no legal effect whatsoever." It further directed that "The Interested Party shall not hold or exercise the office of Patron unless and until lawfully appointed in accordance with the Club's Constitution."

Eliud Owalo was initially appointed as acting patron in October 2025, following the passing of long-serving patron Raila Odinga, with his substantive appointment confirmed on November 1, 2025. Owalo's tenure was marked by significant financial contributions and a clear commercial vision, which were widely credited as pivotal to the team's resurgence. He disclosed to the Sports Disputes Tribunal in June 2026 that he had personally injected over Ksh80 million into the club. Upon his initial appointment, Owalo articulated a vision for professional club management, stating, "The future of football lies in running clubs professionally and independently," and "We want Gor Mahia to operate like successful clubs elsewhere in the world and build long-term financial stability."

Despite the ongoing leadership dispute, Gor Mahia enjoyed a highly successful 2025/26 season on the pitch. They were crowned SportPesa Premier LeagueCompetition·Premier League champions, securing a record-extending 22nd league title and reclaiming the trophy from Kenya Police FC. This triumph came despite an inconsistent start to the season, which saw them placed eighth in the FKF Premier League standings by mid-September 2025, including an early defeat to Bidco UnitedTeam·Bidco United.

The club also reported a substantial financial gain of nearly Ksh200 million from the 2025/26 season. This included Ksh85 million annually from their shirt sponsorship with SportPesa, Ksh31 million from TV partners Azam, and Ksh5 million from sleeve sponsor Plascon. Additionally, Gor Mahia generated over Ksh28 million from matchday revenue and secured more than Ksh32 million in title-winning bonuses, comprising Ksh15 million from FKF, Ksh3.5 million from SportPesa, Ksh1 million from Plascon, and an estimated $100,000 (Ksh12.9 million) from the Confederation of African Football (CAF).

As the reigning FKF Premier League champions, Gor Mahia is set to represent Kenya in the upcoming 2026/27 CAF Champions League. They have been drawn to face the current African champions, Pyramids FC of Egypt, in the first preliminary round, with matches scheduled for September 4-6 and September 11-13, 2026. The club also reached the semi-finals of the 2026 CECAFA Kagame Cup, where they were slated to play Sudan's Al-Hilal on August 4, 2026. The tribunal's ruling now places an immediate focus on resolving the club's internal governance structure as they prepare for these crucial continental and regional engagements.
